Doctors Warned: Face Culpability for Not Reporting Concerns on Sandie Peggie’s Return

During a tribunal, it came to light that senior medical staff who protested the reinstatement of a gender-critical nurse, Sandie Peggie, following her altercation with a transgender colleague, were told they might be held responsible for not adequately reporting safety issues related to patient care.

Sandie Peggie was initially suspended after she raised concerns about sharing a changing room with a transgender doctor, Dr. Beth Upton, at Victoria Hospital in Kirkcaldy, Fife, on the night before Christmas 2023.

Following Dr. Upton’s accusations of bullying and harassment, which also highlighted worries concerning “patient care,” Peggie was placed on special leave.

Peggie has since filed a legal claim against NHS Fife and Dr. Upton, invoking several aspects of the Equality Act 2010, including sexual harassment, harassment connected to a protected belief, indirect discrimination, and victimization. The tribunal, which initially began hearings in February, resumed on July 16 in Dundee.

Charlotte Myles, the service manager who decided to lift Peggie’s suspension on March 7, testified that her decision was met with disapproval from two senior consultants and two senior nurses. Despite the objections, she reinstated Peggie verbally on March 7 and formally on March 12. However, the suspension was reimposed due to complications related to the care of Peggie’s dog, and she eventually returned to work around April 12, 2024.

Myles revealed that although Dr. Kate Searle and Dr. Maggie Currer were against the decision to reinstate Peggie, senior nurse managers Esther Davidson and Louise Curran were unable to provide a concrete response regarding the alleged patient safety concerns.

She recalled visiting Dr. Searle’s office to organize a work schedule and faced further resistance. She warned Dr. Searle about the liability involved if the allegations weren’t properly reported. Myles highlighted that she was solely responsible for reviewing the suspension and her main focus was ensuring patients received care.

Myles expressed her dissatisfaction with the senior medical staff for not following the proper protocols and policies. She emphasized that if incidents occurred and went unreported, those involved were accountable.

Moreover, she mentioned an accusation made by Ms. Davidson alleging that Peggie had used a racial slur against a doctor, which Myles dismissed along with Ms. Curran’s claim that Peggie shared similar gender views as Donald Trump, labeling it as mere gossip.

During further inquiries, Myles was questioned about these alleged comments. She clarified that she had been informed of the racial comment but found no formal report of it; she doubted the accuracy of the claim as the supposed target of the comment did not recall such an incident.

The tribunal heard that Myles had requested previous documentation related to Peggie’s suspension before March 7 but had not seen any risk assessment that justified the initial suspension, thus believing there was no risk involved in lifting it.

The proceedings of the tribunal are set to continue as more testimonies and evidence are expected to be scrutinized.
