REGULAR MEETING MINUTES
January 2, 2007
The Sherburne County Board of Commissioners met in regular session on January 2, 2007, at the Sherburne County Government Center in the City of Elk River, Minnesota, with Commissioner Engstrom, Commissioner Petersen, Commissioner Riebel, Commissioner Schmiesing, and Commissioner Leonard present.
At 9:01 a.m., Brian Bensen, Administrator and Clerk to the County Board, called the meeting to order followed by the Pledge of Allegiance to the flag.
Judge Mary Yunker was present to officiate over the swearing in ceremony. Commissioner’s Ewald Petersen and Felix Schmiesing, Sheriff Bruce Anderson, County Attorney Kathleen Heaney, Recorder Michelle Ashe, and Auditor/Treasurer Diane Arnold came forward to take their Oath of Office. The meeting was recessed for a reception at 9:08 a.m.
Brian Bensen, Administrator and Clerk to the County Board, reconvened the meeting at 9:25 a.m. and called for nominations for the 2007 Chair of the Sherburne County Board of Commissioners. Commissioner Schmiesing nominated Commissioner Riebel. Commissioner Leonard seconded the nomination. There were no other nominations. Commissioner Riebel was unanimously appointed as the 2007 Board Chair of the Sherburne County Board of Commissioners.
John Riebel, Board Chair, called for nominations for 2007 Vice Chair of the Sherburne County Board of Commissioners. Commissioner Leonard nominated Commissioner Engstrom. Commissioner Schmiesing seconded the motion. There were no other nominations. Commissioner Engstrom was unanimously appointed as the 2007 Vice Chair of the Sherburne County Board of Commissioners.
Leonard/Engstrom unanimous to approve the agenda for January 2, 2007 with the following additions: Request to hire at above starting rate for Maintenance Supervisor position.
Discussion was held regarding hiring a Maintenance Supervisor above starting rate. Leonard/Schmiesing unanimous to approve hire rate for John Felipe, Maintenance Supervisor, at $23.50 per hour based on years of experience.
Engstrom/Schmiesing unanimous to adopt Roberts Rules of Order to conduct business for 2007.
Discussion was held regarding the 2007 Sherburne County Board meeting schedule. Schmiesing/Leonard unanimous to set the 2007 County Board meeting dates as follows: First Tuesday of every month starting at 9:00 a.m.; First Wednesday after the first Tuesday at 10:00 a.m. for Workshop Sessions and; Second Tuesday of every month starting at 9:00 a.m. Third Tuesday of every month starting at 9:00 a.m. with the exception of the first two meetings in the month of July (July 3rd and 4th) which shall be cancelled due to the Independence Day Holiday, the third meeting in July (July 17th) which shall be cancelled due to the NACO Annual Conference, and the first two meetings in the month of December (December 4th & 5th), which shall be cancelled due to the Association of Minnesota Counties Annual Conference.
Schmiesing/Leonard unanimous to approve the consent agenda as follows:
a. Approve the Sherburne County Board of Commissioners Regular Meeting Minutes of December 19, 2006 as presented.
b. Authorize acceptance of $15,000.00 from UCARE to be used for Bright Futures training for Public Health and Social Services.
c. Approve a purchase of service contract with Effective Living Center (on file in the Social Services Department) effective 01/09/07 at recommended rates.
d. Approve a purchase of service contract with Minnesota Monitoring (on file in the Social Services Department) effective 01/15/07 at recommended rates.
e. Accept the Department Head Meeting Minutes of November 21, 2006 as presented.
f. Accept payment of Social Services Warrants paid December 14, 2006 in the amount of $22,463.31.
g. Accept payment of Social Services Warrants paid December 20, 2006 in the amount of $6,032.62.
h. Accept payment of Commissioner Warrants paid December 14, 2006 in the amount of $2,380,642.98.
i. Accept payment of Commissioner Warrants paid December 20, 2006 in the amount of $769,659.30
Leonard/Engstrom unanimous to approve expense claims submitted by Commissioners as follows, with the stipulation that each Commissioner abstains from approving his/her own claim: Commissioner Engstrom $384.55; Commissioner Nagorski $308.86; Commissioner Riebel $722.50; Commissioner Schmiesing $789.98; Commissioner Leonard $112.30.
Discussion will be held concerning setting the 2007 County Board Goals. Commissioners were asked to bring suggestions to the next meeting. Commissioner Leonard informed the Board that a committee she is on discussed disposal of unused medications and she asked that this be considered as a goal for 2007.
Discussion was held regarding Committee Appointments. A list with current committee assignments was handed out to the Board for review. Commissioner Schmiesing and Commissioner Engstrom, who are both currently on the Metropolitan Inter County Association, indicated that they would like to remain on this committee. Commissioner Petersen informed the Board that the NorthStar Corridor Development Authority Meeting has been changed; they will meet on Thursday, January 11, 2007. Commissioner Petersen indicated that he would like to be on the NorthStar Corridor Development Authority, Economic Development Authority and Solid Waste Advisory Committee. Commissioner Leonard and Commissioner Engstrom indicated that they would like to be on Long Range Facilities Planning Committee. Further discussion will be held at the January 9th Meeting.
Nancy Riddle, Zoning Administrator, presented the monthly Planning Advisory Commission Report for December 2006.
Discussion was held regarding the request for a Conditional Use Permit for the Grading, excavating or Filling of 1000 to 10,000 cubic yards of materials for a pond. Leonard/Schmiesing unanimous to approve a Conditional Use Permit for the Grading, excavating or Filling of 1000 to 10,000 cubic yards of materials - for a pond. Legal: N1/2 of N1/2 of SW1/4 Sec 8, Twp 35, Rge 26 Baldwin Township 40 acres General Rural District, as requested by Richard Fagerness, as recommended by the Planning Commissioner with the following conditions:
a) All spoils must be removed to a non-wetland area.
b) A seed mix of native plant species from a certified seed dealer should be used for vegetation establishment.
c) The project must follow the plan/description submitted with application (including but not limited to the 4:1 side slopes).
d) The applicant will contact the Sherburne County Zoning Office for a final inspection to ensure the project has been complete in accordance with the Wetland Conservation Act Exemption issued on 10/12/2006.
e) The applicant shall agree to permit the County to inspect the property.
f) The applicant shall comply with all local, state and federal laws.
g) The findings in Sec 18, Subd 5, Item 3 have been made.
Discussion was held regarding the request for a Conditional Use Permit for a Home Business in an Accessory Building-Auto Repair. Commissioner Schmiesing asked why a Planning Commission Member abstained from the vote on this request; Ms. Riddle replied that a reason was not given. Commissioner Engstrom asked about uses of buildings on the property. The property is coming into compliance with the Conditional Use Permit. Leonard/Engstrom unanimous to approve a Conditional Use Permit for a Home Business in an Accessory Building - Auto Repair: Address: 4726 35th Ave SE, St. Cloud, Mn Legal: S450’ of E1/2 of SE1/4 Sec 20, Twp 35, Rge 30 Haven Township 13.63 acres Agricultural Use District, as requested by Steve Wieber, as recommended by the Planning Commission with the following conditions:
a) Limit business to one (1) employee other than family. Business is to remain small in nature.
b) Limit customer cars per week. Two (2) per day with no more than 30 per month.
c) Business hours will be Monday – Friday 7AM – 7PM (noise will be limited and subject to Haven Township’s noise regulations).
d) No more than 3 cars can be stored outside in view from driveways or other property owners. All auto parts or related parts shall be screened from view. No junk cars or parts of cars shall be stored on site. This would include any vehicle that does not have current tabs to be driven on public roads. This would not apply to inside storage.
e) No underground storage of oil or chemicals will be permitted. All above ground chemicals shall be limited to 55 gals or less. Owner shall provide for proper clean up of spilled oil, fuel or any products.
f) Autobody repair with painting will not be permitted.
g) No signage will be allowed.
h) All chemicals and hazardous materials shall be disposed of according to MPCA and OSHA standards.
i) The applicant shall agree to permit the County to inspect the property.
j) The applicant shall comply with all local, state and federal laws.
k) The Findings in Sec 18, Subd 5, Item 3 have been made.
Discussion was held regarding the Request for Preliminary Residential Standard Plat approval of Anderson Pine Cone Estates. Schmiesing/Petersen unanimous to approve the Preliminary Residential Standard Plat of Anderson Pine Cone Estates consisting of 6 Lots and 1 Outlot (1 existing residence) Address: 25275 164th St, Big Lake Legal: Th pt of Gov’t Lot 1 Sec 22, Twp 34, Rge 27 that lies Ely of th centerline of CSAH 15 also Gov’t Lot 3 Sec 15, Twp 34, Rge 27 ex th following three desc parcels (full legals on file) Orrock Township 37.42 acres General Rural District and within the Recreational Development Lakeshore District of Ann Lake, as requested by Dean Anderson (Wayne and Heather Kossila property), as recommended by the Planning Commission with the following conditions:
a) Park fees for four (4) lots at $800 per lot.
b) A copy of NPDES permit must be submitted to Zoning prior to being scheduled for final plat approval.
c) Developer shall enter into a Developer’s Agreement with the County Attorney’s office.
d) On the exception property owned by Bryon Eckholm, it is required that his existing access to CSAH 15 must be relocated to proposed 163rd Street as soon as the street is completed. Zoning received a letter signed by both Dean Anderson & Byron Eckholm stating this will be done. Public Works will require that in addition to the access being removed, a ditch section created, turf established and trees or shrubs planted at the ROW line to insure compliance. Address correction will be required.
e) Must comply with all conditions listed in Public Works Letter dated June 14, 2006
Discussion was held regarding a request for Final Residential Standard Plat approval of Kalley Meadows. Leonard/Engstrom unanimous to approve the Final Residential Standard Plat of Kalley Meadows consisting of 10 Lots and 1 Outlot Legal: Th pt of th NW1/4 of th SW1/4 of Sec 1, Twp 34, Rge 26 lying E of th W 50’ ex th E 554.43’ of th W 604.43’ N 574.93’ of sd NW1/4 of SW1/4 Sec 1, Twp 34, Rge 26 Livonia Twp 31.02 acres General Rural District, as requested by Jansen Construction Inc. as recommended by the Planning Commission with the following conditions:
a) Developer shall enter into a Developer’s Agreement with the County Attorney’s office.
b) The Developer has one year to record the plat per Section 4, Subdivision 3 of the Subdivision Ordinance.
Discussion was held regarding the request for Preliminary and Final Simple Plat approval of Zebulon Crossing. Petersen/Engstrom unanimous to approve the Preliminary and Final Simple Plat of Zebulon Crossing consisting of 1 Lot Legal: Th S357.70’ of th E532.86’ of th SE1/4 of th NE1/4 and th E532.86’ of th NE1/4 of th SE1/4 lying N of th Nly (full legal on file) Sec 25, Twp 33, Rge 27 Big Lake Township 5.13 acres General Rural District, as requested by Great River Energy (Ken and Douglas Warneke property), as recommended by the Planning Commission with the following conditions:
a) The Public Works Department will require the following:
1. If and when approved, direct access for the parcel to CH 35 will be granted by Access Permit as a “temporary access”. The proposed facility can maintain this direct access to CH 35 for the lifetime of the facility, as long as it operates under its current proposed use indicated on the Plat Plan dated 8/30/06. The access shall be constructed at or near the north boundary of the property.
2. For record purposes the proposed traffic to/from the site shall not exceed 10 trips per day (an exception to this would be under an emergency situation)
3. In lieu of an easement that provides “permanent access” for the parcel, the Hwy Dept will require a covenant or restriction that obligates the remnant or parent parcel to provide future access to a future interior street when it subdivides. The covenant must be recorded at the same time as the plat.
b) The fence located within the CH 35 right of way must be removed.
c) Park fees shall be paid for one lot for $800.
d) Developer shall enter into a Developer’s Agreement with the County Attorney’s office.
e) Developer has one year to record the plat per Section 4, subdivision 3 of the Subdivision Ordinance.
Discussion was held regarding the request for a Conditional Use Permit for a Contractor’s Yard. Ms. Riddle informed the Board that there were still issues to work out with Public Works on this request and stated that the applicant has signed a 60 Day Waiver. Schmiesing/Engstrom unanimous to table the request for a Conditional Use Permit for a Contractor’s Yard: Address; 6346 River Road SE, Clear Lake, Mn Legal: Th pt of th NE1/4 of th NE1/4 lying Sly of th Old Clear Lake-Clearwater Road and Ely of CSAH 8 and Nly of a line desc as follows (full legal on file) Sec 23 and Sec 14, Twp 34, Rge 30 Clear Lake Township 10.10 acres Agricultural Use District, as requested by David Phillips.
Discussion was held regarding Amendments to the Sherburne County Subdivision Ordinance. Leonard/Petersen unanimous to approve Amendments to the Sherburne County Subdivision Ordinance regarding submittal requirements and the requirement of the lowest floor and lowest entry elevations on a Simple Plat application as recommended by the Planning Commission as follows:
Section 10 Standard Plats: Subd 5 Final Plat; Item 1 Submission Information; (B) and Section 10.1 Residential Planned Unit Development; Subd 15 Platting Procedure; Item 4 Preliminary Plat; Item C5 Final Plat; Item 1 Submission information: Change number of Final Grading and Drainage Plan copies to “Two (2) full size and two (2) 11”x17” copies” and add the following wording: “The Grading and Drainage Plan shall include an index for Low Floor Elevations (LFE) and Lowest Entry Elevations (LEE) for each lot. The Grading and Drainage Plan shall be consistent with the Final Plat.”
Section 11 General Regulations: Subd 1 Alternative Design Standards Item 6 Developable Lot (C3) Change to read: “Each lot must have 10,000 5,000 square feet of contiguous land that is 36 inches above mottling. This area shall be a minimum of 60-feet in width and 60-feet in length.”, This may be accomplished by filling in non-wetland area. The house shall be located in this area and all fill below the floor areas and foundation shall be certified as structural fill by a geotechnical engineer.

Chris Stalpes, Big Lake, was present to discuss the Becker/Big Lake Hockey Association plans for a proposed ice arena. Brian Bensen, Administrator, informed Mr. Stalpes of the current feasibility study being done on the Sherburne County Fairgrounds property. Mr. Stalpes provided a document outlining their proposal for an arena and reviewed that they are providing this information to other entities to keep their options open. They currently have 5 acres of property in the Big Lake Marketplace development that was donated by the developer. The City of Big Lake is currently doing a feasibility study for a youth athletic complex. He stated the Association’s main goal is to have an arena in the area; it does not matter if it is in Big Lake or Becker. No action taken.
The Chair declared a recess at 10:36 a.m. and reconvened the meeting at 10:49 a.m.
Diane Arnold, Fiscal Analyst, was present to review the bids received for the publication of the commissioner proceedings, delinquent tax list, financial statement, and alternate financial statement. Schmiesing/Petersen unanimous to accept the apparent low bidder for publications as follows: Citizen Newspaper for publication of delinquent tax list at a cost of $.55 per line. Elk River Star Newspaper for publication of the financial statement at a cost of $.60 per line. Citizen Newspaper for publication of the Alternate Publication Financial Statement in the amount of $.55 per line. Citizen Newspaper for publication of Commissioner Proceedings in the amount of $.48 per line. The above motion shall be effective immediately until December 31, 2007.
Nancy Riddle, Zoning Administrator, was present to discuss a letter written by staff addressing the concerns discussed at the December 12, 2006 County Board Meeting regarding proposed changes to Mississippi River Scenic and Recreational River Ordinance. Commissioner Petersen stated the language should be more forceful. The letter should request that they site the authority to do the proposed changes and to request written response back from the DNR. The Board also discussed how the State is shifting responsibility to local government as an unfunded mandate. Commissioner Schmiesing suggested that Wright and Stearns Counties be informed of our intent to request zoning to be the same on both sides of the River and request that they comment as well. Ms. Riddle will make revisions to the letter and bring it to the County Board for approval on January 9, 2007.
Nancy Riddle, Zoning Administrator, was present to discuss a decision on the EAW and Conditional Use Permit for Bauerly Brothers, Inc. and Louis Stark Gravel Mining Pit. Leonard/Schmiesing unanimous to approve a negative declaration on the need for an EIS for Bauerly Brothers, Inc. and Louis Stark Gravel Mining Pit. Leonard/Schmiesing unanimous to remove the request for a Conditional Use Permit for Bauerly Brothers, Inc. and Louis Stark Gravel Mining Pit from the table and remand to the Planning Commission for review of conditions to be set based on information obtained through EAW process.
At 11:15 a.m. the Chair recessed the Regular Meeting and Opened the Housing and Redevelopment Authority Annual Meeting.
At 11:21 a.m. the Chair adjourned the Housing and Redevelopment Authority and opened the Regional Rail Authority Annual Meeting.
At 11:28 a.m. the Chair adjourned the Regional Rail Authority and reconvened the Regular Meeting.
